2. Visits to this website

When you visit this website, our hosting provider records technical data such as your IP address, browser, the page requested and the date and time. We use it to provide the service, keep the site secure and detect errors, based on our legitimate interest in operating the site securely (Art. 6(1)(f) GDPR). It is kept only for as long as needed for those purposes.

This website uses no analytics or advertising tools, and stores no cookies or other data of its own on your device. See our Cookie policy for more information.

3. Bookings through our online booking system

Our online booking system, on our Reservations page, is provided by TheFork (La Fourchette SAS) and loads from its servers. When you open that page, TheFork receives technical data about your connection, such as your IP address. If you make a booking or a booking request, it receives the details you enter in the form.

• Purpose: to manage your booking. Bookings for groups of 7 or more are requests that AMADES accepts or declines.
• Legal basis: managing the booking you ask us for (Art. 6(1)(b) GDPR).
• Joint controllership: according to TheFork’s privacy statement, TheFork and the restaurant are joint controllers of the data of bookings made through its reservation module. TheFork also processes your data under its own privacy statement (opens in a new tab).
• Card guarantee for groups: group requests require card details as a guarantee. You enter them directly in the booking system’s form, and TheFork processes them with its payment providers. AMADES has no access to your card details.
• Retention: we keep booking data for up to 12 months after the booking date. If an issue, claim or charge arises, we keep it blocked for the limitation period of any resulting legal action. TheFork keeps its own data under its privacy statement.

4. Late-cancellation and no-show charges

If a late-cancellation or no-show charge applies, the data that forms part of our accounting and tax records is kept for the periods required by law: six years under Article 30 of the Spanish Commercial Code and, where applicable, the periods under Law 58/2003 (General Tax Law) (Art. 6(1)(c) GDPR).

5. Contact by phone or email

If you call or write to us, for example about a booking, a press enquiry or a collaboration, we use the details you give us to reply. If you want to book, we will ask you to do so through our online booking system.

• Legal basis: taking steps at your request before entering into a contract (Art. 6(1)(b) GDPR) or our legitimate interest in answering the enquiries we receive (Art. 6(1)(f) GDPR).
• Retention: up to 12 months after our reply, unless the enquiry leads to a booking, contract or claim, in which case that period applies.

6. Job applications

If you email us your CV, we use it to consider your application to work at AMADES, on the basis of taking steps at your request before entering into a contract (Art. 6(1)(b) GDPR). Please send only the information needed for this.

We keep your CV for as long as the selection process lasts and delete it when it ends, unless you expressly allow us to keep it longer for future openings; in that case, we keep it until you withdraw your permission, which you can do at any time.

7. Our social media profiles

We have profiles on Instagram and Facebook. This website only links to them and loads no content from these networks. If you interact with us there, their own privacy policies also apply.

8. Recipients and service providers

We do not sell your data or share it with third parties, except where required by law. The following are involved in providing our services:

• Netlify, Inc., the hosting provider of this website, as processor.
• TheFork (La Fourchette SAS), the provider of our online booking system, as joint controller of booking data, and its payment providers.
• Google (Google Workspace), our email provider, as processor.
• Public authorities, judges and courts, where required by law.

9. International transfers

Netlify, Inc. is based in the United States and is certified under the EU-U.S. Data Privacy Framework; its data processing agreement also includes the European Commission’s standard contractual clauses. According to its privacy statement, TheFork transfers data outside the European Economic Area only to countries with an adequacy decision or under standard contractual clauses or other appropriate safeguards.

Google processes our email data as processor under its Cloud Data Processing Addendum. Where it processes data outside the European Economic Area, the transfer is covered by the European Commission’s standard contractual clauses or other safeguards provided for in that addendum.

10. Blocking and deletion

When your data is no longer needed, we will delete it. Where the law requires, we will first keep it blocked, available only to judges, courts and the competent authorities, for the limitation period of any possible liabilities, and then destroy it (Art. 32 LOPDGDD).

11. Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability at any time, and withdraw any consent you have given, without affecting the lawfulness of earlier processing. To do so, email info@amades.es or write to Carrer dels Banys Nous, 8, 08002 Barcelona, Spain, stating which right you wish to exercise. We may ask you to prove your identity if necessary.

For bookings made through our online booking system, you can contact either us or TheFork.

If you believe we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es (opens in a new tab)).

12. Automated decisions

Through this website we do not make decisions based solely on automated processing of your data, and we do not build customer profiles. TheFork processes booking data under its own privacy statement (opens in a new tab).

13. Changes to this policy

We may update this policy when our services or the law change. The current version is always the one published on this page.
